By accessing or using Vibly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Vibly is an AI-powered platform that generates mobile application code based on user descriptions. The Service uses artificial intelligence to create React Native applications that users can preview, customize, and export.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use this Service. One person or entity may not maintain more than one account. You are responsible for all activities that occur under your account.

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable unless otherwise stated. We may change subscription prices with 30 days notice. Credits are used to generate apps and are allocated based on your subscription plan. Unused credits expire at the end of each billing period. Credits are non-transferable and have no cash value. You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds for unused portions of a billing period.

You agree not to use the Service to generate malicious, harmful, or illegal content, create apps that violate third-party intellectual property rights, generate apps containing hate speech, harassment, or discriminatory content, attempt to reverse engineer or extract our AI models, circumvent usage limits or abuse the Service, share account access with unauthorized users, or use the Service for any unlawful purpose.

You retain ownership of the prompts and descriptions you submit. By using the Service, you grant us a license to process your content to provide the Service. Code generated by the Service is provided under a permissive license. You may use, modify, and distribute generated code for personal or commercial purposes. However, generated code is provided "as-is" without warranty. Vibly, including its AI models, interface, and branding, remains our intellectual property. You may not copy, modify, or create derivative works of our Service.

Generated apps may contain errors, bugs, or security vulnerabilities. You are responsible for reviewing and testing generated code before use. We do not guarantee that generated code is free from third-party IP claims. AI-generated content may sometimes produce unexpected or inappropriate results.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Vibly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
